Terms of Service

Please read these terms of service carefully.

Webzure offers its customers hosting and website services to “you.”

Hosting Services include WordPress hosting, Remixer, email hosting services, VPS, and dedicated hosting.

Cloud Services offer cloud services and Domain registration services.

Services provided by Webzure will collectively be referred to as “Services” in this notice.

By using Webzure Services, the Customer agrees to these Service Terms and other policies or conditions referenced or published by us (collectively “Terms”). If the Customer does not accept these Terms, they should not open an account or purchase, access, or use the Webzure Services in any way.

These Terms create a binding legal agreement between Webzure and any person or organization (“Customer” or “You”) purchasing, accessing, or using the Webzure Services. The Customer represents, warrants, and accepts that they have full authority and power to enter into these Terms and perform under these Terms, or if the Customer is using these Services on behalf of an organization, entity, or group, the Customer is authorized to accept these Terms.

Financial Arrangements

  1. The Customer agrees to a minimum thirty (30) day contract from the start of the service. The exact contract duration is determined at registration.
  2. The Customer accepts responsibility for all fees and charges associated with an account.
  3. If the Customer wishes to cancel shared Web Hosting services within thirty (30) days from the initial registration date for any reason (excluding deactivation due to Service Terms or Spam Policy violations), they may do so and will receive an immediate refund.
  4. Services provided by third parties and Webzure partners are not part of the 30-day refund policy and do not qualify for early termination credits. Billing stops at the end of the cancellation period.
  5. Except for shared hosting services provided by Webzure, no refunds will be issued for services provided by Webzure partners and third parties (such as domain name, hosting, server, cloud services, software) if the encountered situation meets the expected performance. This means that the services do not harm the customer or cause significant inconvenience. Harm and significant inconvenience are defined as situations where the service becomes completely non-functional, inaccessible, or the customer is unable to use the service. Delays, interruptions, or delivery issues are considered part of the expected standard operating conditions for these services, and under no circumstances will refunds be provided for such events.
  6. AUTOMATIC RENEWAL: Upon the contract’s expiration, it will renew automatically for the original term length at the current rate without promotions until canceled.

Webzure will automatically renew the relevant service and charge the payment method associated with your account when renewal time comes. If you do not wish for a service to renew automatically, you may choose to cancel that service. In such cases, unless you manually renew your Services before that date, they will terminate at the end of the current term.

To avoid automatic renewals, all Services must be canceled before their renewal dates. Renewal dates take effect at midnight (GMT+3).

If the Customer’s payment card is expired, invalid, or otherwise unchargeable, the customer agrees that Webzure may use other payment methods associated with the customer’s bank account (such as new credit card information from your card issuer). If a shared hosting service is terminated after the 30-day money-back guarantee period, the service will be canceled before the next payment due date, and no further billing will occur or any payment refunded. Any non-refundable fees must be paid before account cancellation. You can cancel your account through the Account Management panel page.

  1. The “30-Day Money Back Guarantee” offer is only valid when payment is made with a credit card for shared web hosting. Other payment methods are not refundable. Refunds are only processed for shared hosting. Domain registrations (including the value of used free domain registrations included in the plan) are not refundable under any circumstances. SSL certificates are non-refundable. The value of any AdWords credits or other third-party add-ons is not refundable. For more information, see the Domain Registration Terms.
  2. Violation of Webzure Terms may result in immediate and permanent deactivation without a refund, at Webzure’s discretion.
  3. Webzure reserves the right to disable or suspend any account or service without a refund at any time if there is reasonable suspicion of any term being violated.
  4. Disputed charges (“chargebacks”) associated with any Webzure account may result in the immediate and potentially permanent disablement of Services or the account at Webzure’s discretion. A minimum of 100 USD must be in the relevant account for Service or account reactivation following a dispute.
  5. Webzure reserves the right to modify its service plans, fees, and applicable charges at any time. Services containing outdated or unsupported features may incur additional maintenance fees. In such cases, Webzure will notify the customer and allow them to cancel the Services without an extra change fee. However, previously assessed fees will not be refunded.
  6. Webzure will make commercially reasonable efforts to make the Dedicated service available 99.9% of the time during each monthly billing cycle. If Webzure fails to meet this service level, you will be eligible for a credit towards future Dedicated service billing cycles based on Unavailability in that month.
  7. For the purposes of this agreement, Unavailability means either (a) the Dedicated service is unresponsive or (
  • b) the Dedicated service gives a server error response to valid user requests for more than 60 consecutive seconds.
  • Downtime resulting from scheduled maintenance is excluded from these conditions and will not be considered in service credit calculations. Scheduled maintenance is defined as maintenance announced at least 3 days in advance and not exceeding three hours in any month.

Taxes

  1. Webzure is not responsible for any taxes or other fees to be paid in accordance with or related to purchases made from or through the Webzure Web Hosting server by the Customer. The Customer takes full responsibility for all taxes and fees of any nature associated with such products sold.
  2. Material Products
  3. The Customer will provide material and data in a condition that is “server-ready,” which does not require any additional manipulation on the part of Webzure. Webzure will not validate this information for content, correctness, or usability.
  4. Use of the Webzure service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the Customer’s Web space.
  5. Examples include:
  6. Web Publishing: Requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, Sound, Image mapping, etc.
  7. CGI-Scripts: Requires knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc.
  8. The Customer agrees they have the necessary knowledge to create their Web space. The Customer agrees that it is not the responsibility of Webzure to provide this knowledge or support outside the defined service of Webzure.
  9. Webzure will exercise no control whatsoever over the content of the information passing through the network, provided it complies with all other conditions stated in our Terms of Service and Acceptable Use Policy documents.
  10. Webzure reserves the right to police its network to verify compliance with all agreed-upon Terms.
  11. The Customer agrees to cooperate with any reasonable investigation into any suspected violation of the Terms. Non-cooperation will result in immediate account/service plan deactivation.
  12. Webzure reserves the right to disconnect any website or server deemed a security threat to Webzure’s customers, servers, or network.
  13. Opening multiple accounts or service plans in an effort to bypass any restrictions or overage fees set forth by Webzure will result in the termination of all Services.
  14. Webzure makes no express or implied warranties or representations with respect to the service it provides. Webzure expressly disclaims any implied warranty of merchantability or fitness for a particular purpose and will not be liable for any delays, delivery failures, service interruptions, including, but not limited to, data loss, errors, or omissions that the Customer may incur. Any information obtained through Webzure is at the Customer’s own discretion and risk, and Webzure explicitly disclaims any responsibility for the accuracy or quality of information obtained through its services. Mention of connection speeds associated with Webzure’s Services represents the maximum achievable speed. Webzure does not guarantee that the Customer will achieve those speeds, as they are dependent on various factors, including your own internet connection! Webzure limits its liability for any damages to the Customer to the proportional monthly charge during any period of unavailability or other service interruption.
  15. Webzure expressly disclaims any liability for any damages arising from such unavailability. If the material is not “server-ready,” Webzure may, at its discretion, reject this material. Webzure will notify the Customer immediately of its refusal of the material and afford the Customer the opportunity to amend or modify the material to satisfy the needs and/or requirements of Webzure. If the Customer fails to modify the material, as directed by Webzure, within a reasonable period, the agreement shall be deemed to be terminated.
  16. All domain names registered, ‘parked,’ or otherwise associated with a Webzure hosting plan not immediately linked to a Webzure hosting plan will automatically be directed to a “Coming Soon” webpage. The Coming Soon webpage is subject to change by Webzure at any time without prior notice and may include links to additional products and Services offered by Webzure, among others, not limited to these.

Trademarks and Copyrights

  1. The Customer guarantees that they have the right to use the trademarks and copyrights relevant to all content and/or products used in connection with the account.
  2. Hardware, Equipment, and Software
  3. The Customer is responsible for and must provide all phone, computer, hardware, and software equipment and services necessary to access Webzure Services.
  4. Webzure makes no representations, warranties, or assurances that the Customer’s equipment will be compatible with the Webzure Services.
  5. Guaranteed Uptime
  6. Webzure guarantees 100% uptime. Failure to achieve 100% uptime will result in customer compensation according to the guidelines stated herein.
  7. If the Customer’s website, databases, email, FTP, SSH, or webmail become unusable as a result of failure in Webzure’s systems for reasons not excluded by scheduled maintenance,
  • coding, or configuration errors, the Customer is entitled to compensation.
  • The Customer will receive a Webzure credit equal to 3 (three) days of service for every 3 (three) hours (or part thereof) of service interruption, up to a maximum of 10% of the Customer’s next prepaid hosting service renewal fee.
  • Webzure’s assessment of downtime begins when the Customer opens a support ticket to report the issue.

Webzure Dedicated Server Terms

  1. Bandwidth pricing and measurement frequency are subject to change at Webzure’s discretion. Customers affected by such changes will be informed by Webzure at least thirty (30) days in advance.
  2. Regardless of whether the downtime originates from the Customer, Webzure, or Webzure’s upstream providers, Webzure is not under obligation to compensate for downtime.
  3. The Customer agrees that payments for leased servers are NON-REFUNDABLE. For example, if the Customer pays for twelve (12) months of service, the service will be provided for twelve (12) months, and no refund will be given if the Customer chooses to stop service with Webzure mid-term. Dedicated services will be billed monthly; existing Dedicated customers may remain on a prepaid billing plan, but new customer accounts will be subject to a usage billing plan.

Termination or upgrade of Dedicated services will result in the following refund and billing procedures:

  1. Prepaid Billing Dedicated Plan: Any termination or upgrade will result in a refund of the pro-rated value of the plan for the final billing period.
  2. Usage-Billing Dedicated Plan: Any termination will result in billing to the nearest hour for usage.
  3. Hardware upgrades for an existing ‘platform’ (defined as a motherboard/chassis combination) will be performed by Webzure and will be subject to an additional one-time labor fee of 100 USD in addition to an increase in the Customer’s standard monthly fee.
  4. Any applied labor required by the Customer (including, but not limited to, reinstallation of the operating system on the server) will be performed by Webzure and will be subject to a one-time labor fee of 100 USD per incident.
  5. Webzure reserves the right to change advertised dedicated server packages on its website at its discretion. Webzure is not required to upgrade Customers’ hardware or bandwidth allocation as a result of a pricing or service package change. Any such hardware upgrades requested by the Customer will be subject to an additional charge of 200 USD. Customers are not required to upgrade their hardware due to a price change.
  6. For managed servers, Webzure is responsible for the security of the network, kernel, and base operating system (defined as standard debian packages that come installed with the server). Webzure may take any steps it deems necessary at any time to maintain the security of your server (this generally involves applying security patches and upgrading the entire operating system).
  7. Webzure is not responsible for informing unmanaged server customers of the need to apply patches. Failure to comply with these terms constitutes grounds for contract termination without refund. Webzure reserves the right to take any action it deems necessary to protect the security and integrity of the Webzure network at any time, including on unmanaged dedicated servers.

Age

  1. The Customer affirms that they are at least 18 years of age or that their parent or legal guardian will act as the “Customer” under this agreement.

Termination

  1. This agreement may be terminated by either party without cause by giving the other party 14 days written notice. Webzure will accept termination by electronic mail. Notwithstanding the above, Webzure may terminate service under this agreement at any time, without penalty, if the Customer fails to comply with the terms of this agreement, including non-payment. Webzure reserves the right to charge a reinstatement fee.
  2. Limited Liability
  3. The Customer expressly agrees that the use of Webzure Services is at the Customer’s sole risk. Webzure, its employees, affiliates, agents, third-party information providers, merchants, licensors, or the like, do not warrant that Webzure Services will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of the Services or as to the accuracy, reliability, or content of any information service or merchandise contained in or provided through the Webzure Services, unless otherwise expressly stated in this agreement.
  4. Under no circumstances, including negligence, shall Webzure, its offices, agents, or anyone else involved in creating, producing, or distributing Webzure Services be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the Webzure Services; or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to Webzure’s records, programs or services. The Customer acknowledges that this paragraph shall apply to all content and services available through Webzure.
  5. Notwithstanding the above, the Customer’s exclusive remedies for all damages, losses, and causes of actions whether in contract, including negligence, tort or otherwise, shall not exceed the aggregate dollar amount which the Customer paid directly to Webzure in the six (6) months prior to the claim.

Promotion Codes

  1. By using a promotion (“promo”) code, you waive the option to indicate who referred you to Webzure.
  2. You cannot change/submit a promo code or referrer after completing signup.
  3. Promo codes/referrers are for new customers only. If you use one, you cannot host any domain with your account that was previously hosted with Webzure.

Indemnification

The Customer agrees to defend, indemnify, save and hold Webzure harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees asserted against Webzure, its agents, its customers, officers, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the Customer, its agents, employees, or assigns. The Customer agrees to defend, indemnify and hold harmless Webzure against liabilities arising out of:

  1. Any injury to person or property caused by any products sold or otherwise distributed in connection with Webzure’s Server;
  2. Any material supplied by the Customer infringing or allegedly infringing on the proprietary rights of a third party;
  3. Copyright infringement;
  4. Any defective products sold to customers from Webzure’s server.
